NY Court Orders Redistricting Commission to Draw a “Second” Congressional Map

Today New York's Supreme Court, Appellate Division directed the state's Independent Redistricting Commission (IRC) to submit a second congressional map to comply with the NY State Constitution. This decision (with 2 of 5 judges on the panel dissenting) will likely be appealed to the state's highest court. A state court has already required the IRC to draw and submit a second state house map after its initial failure to agree on any state redistricting map in January of 2022. U.S. Supreme Court Rejects Exclusive Power of State Legislatures to Draw Redistricting Maps in NC Case

On Tuesday the U.S. Supreme Court held that state legislatures do not have exclusive and independent authority to set the rules regarding federal elections under the U.S. Constitution's Elections Clause. This idea had been dubbed the "independent state legislature theory." Practically speaking, this decision affirmed the North Carolina Supreme Court's authority to review the state legislature's congressional districting plans for compliance with the state constitution. Maryland State Court Throws Out 2021 Congressional Map Citing Extreme Gerrymandering

On Friday, the Senior Judge of the Circuit Court for Anne Arundel County signed an order prohibiting use of the congressional map that the Maryland legislature approved - over a gubernatorial veto - during a special session in December 2021. State officials were given five days to redraw the map. The legislature is currently in session until April 11. There is no word on whether the state will appeal. Read the order and opinion. U.S. Supreme Court Denies Request to Block North Carolina Court’s Congressional Map

On Monday the U.S. Supreme Court denied an emergency application for a stay of the North Carolina State supreme court's decision to invalidate the congressional map that the legislature enacted in 2021 and the state trial court's decision to block a second map enacted by the legislature on February 17. If the high court had granted an emergency stay, the upcoming 2022 elections would have been conducted under the legislature's Feb. 17 map, while the court considered the case for a decision at some later date. The New York State Independent Redistricting Commission met on Monday, Jan 3, but could not come to a consensus on any redistricting map. The members split 5-5 on votes for congressional, state senate, and state house maps. Instead, the commission sent two versions of each to the state legislature for consideration. New York Law School Launches Public Redistricting Mapping Project

New York, NY (October 27, 2021) – New York Law School’s (NYLS) New York Census and Redistricting Institute has launched a statewide Public Mapping Redistricting Project to coincide with the 2021 state redistricting cycle. Student teams from New York’s higher education institutions have been invited to participate in drafting maps for New York’s congressional, state senate, and state assembly districts and submit them to the State.
