North Carolina’s congressional map flipped from court-drawn to legislature-drawn over the course of the 2020 redistricting cycle. In February 2022, the North Carolina Supreme Court struck down the legislature’s 2021 plans as unconstitutional partisan gerrymanders in Harper v. Hall. It directed the use of a court-selected congressional plan crafted by special masters for the 2022 election only. In April 2023, however, a reconstituted court reversed course in Harper v. Hall II (2023), holding partisan-gerrymandering claims non-justiciable under the state constitution. The General Assembly then enacted a new congressional plan on October 25, 2023, which has governed subsequent elections. On October 22, 2025, the General Assembly enacted a new congressional map for use in the upcoming 2026 elections. Litigation is pending.
State legislative districts were redrawn in the same 2023 legislative session following the Harper v. Hall II decision. Previously, the 2021 House and Senate maps were revised for the 2022 election under the Harper litigation (with the trial court accepting the legislature’s remedial legislative plans while rejecting the legislature’s remedial congressional plan). Lawmakers enacted fresh chamber maps on October 25, 2023. The Senate plan in S.L. 2023-146 (SB 758) and the House plan in S.L. 2023-149 (HB 898).
