Florida’s post-2020 congressional redistricting turned into a rare, governor-driven rewrite followed by nonstop litigation. After vetoing the Legislature’s first plan in March 2022, Governor Ron DeSantis called a special session. Lawmakers passed his map in April 2022 (ch. 2022-265). Within hours, voting-rights groups sued in state court, and a Leon County judge preliminarily enjoined use of the map due to its treatment of North Florida’s former District 5, but the First District Court of Appeal stayed and later reversed that injunction. In September 2023, the state trial court overturned the congressional map, but the appellate court reversed. In federal court, a three-judge panel allowed the map to remain in place for 2024. The state case continued, and in July 2025, the Florida Supreme Court upheld the map against “non-diminishment” claims under Florida’s Fair Districts Amendment, cementing the 2022 plan unless and until the Legislature revisits it.

Following the U.S. Supreme Court's April 29, 2026, decision in Louisiana v. Callais, Governor DeSantis called a second special session - originally announced on January 7, 2026, and held beginning April 28, 2026 - and proposed a new congressional map targeting four Democratic incumbents.  The Legislature passed the plan in two days, and DeSantis signed it into law on May 4, 2026 (HB 1D). Three separate lawsuits were filed against the map within 48 hours in Leon County Circuit Court, all challenging the new map as a violation of the Fair Districts Amendment's ban on partisan gerrymandering.

By contrast, the state legislative maps followed Florida’s constitutionally scripted process. The Legislature adopted a 40-Senate/120-House plan by joint resolution in February 2022, triggering automatic review. On March 3, 2022, the Florida Supreme Court approved the maps, making them operative without gubernatorial signature. Subsequent challenges have been narrow: a three-judge federal court in Tampa tried a racial-gerrymandering suit focused on Senate District 16 around Tampa Bay in June 2025 and upheld the map in an August ruling.

In this week’s edition of Facing South Florida: CBS News Miami's Jim Defede takes a deep dive into Florida’s newly-redrawn congressional maps. The new maps could provide Republicans up to four new seats in the latest salvo in the national redistricting battle initiated by President Donald Trump. We hear from state senator Lori Berman, the Democratic minority leader, who calls the new map “an absolute partisan, illegal gerrymander.” Berman also criticizes the secrecy surrounding the new maps, and says the DeSantis administration made no secret of the partisan motivation behind the new maps. “The thing that struck me the most about this special session was when we questioned the map maker (Jason Poreda) and he told us that he did it with partisan intent,” she says. Defede also talks with former Miami Beach mayor Dan Gelber, who was the main legal advisor for the “Fair Districts” amendment which voters passed in 2010. Gelber says the redrawn congressional maps are a clear-cut violation of the state’s constitution. “Of course they violate the Fair District's amendments,” Gelber says. “The Fair District amendments say you can't draw a map with the intent to favor or disfavor a political party or an incumbent. And they've all, but … actually admitted they were drawn with partisan intent. So clearly they violate the Fair District amendments that the people of Florida wanted in their constitution.
