After the 2020 census, Montana’s congressional redistricting was conducted by the Montana Districting and Apportionment Commission, a five-member bipartisan body established by the state constitution. Because Montana regained a second seat in the U.S. House for the first time since 1993, the commission’s task was to create two congressional districts rather than adjust existing boundaries. Following public hearings and draft proposals, the commission adopted a final two-district congressional map on November 12, 2021, generally dividing the state into a western and an eastern district. The plan took effect without legislative approval and has been used for elections since 2022. While the process drew political debate, the congressional map was not invalidated by any state or federal court, and no successful litigation altered the commission’s final plan.
The state legislative redistricting process in Montana was also led by the Districting and Apportionment Commission. After developing preliminary legislative maps, the commission submitted a proposed plan to the Montana Legislature at the start of the 2023 legislative session, as required by the state constitution. Lawmakers reviewed the proposal and returned nonbinding recommendations, after which the commission finalized the state House and state Senate districts and filed them with the secretary of state in February 2023. The districts were effective for the 2024 legislative elections. As with the congressional map, the legislative plans were adopted by the commission rather than the legislature itself and were not overturned by court action.
